The collection of financial data is necessary for processing your payment or for making a payment.

• Preparation of a quotation or administration in general
• Accounting and invoicing
• Making the Website easily accessible and improving service quality
• Marketing purposes, including direct marketing

If Procotex uses your personal data for direct marketing purposes, you always have the right to oppose this via a simple request (possibility to ‘unsubscribe’).

Depending on the information you have provided Procotex with (telephone number, postal address, mobile number, e-mail address), Procotex may contact you through the relevant channels (by telephone, post, SMS or e-mail) with a view to informing you about its products, services, about future events or offers or about news that Procotex believes may be relevant to you. • The processors act exclusively on behalf of Procotex;
• Procotex has made clear arrangements in its agreement with these third parties regarding the quality of data processing in accordance with the obligations imposed by the relevant privacy legislation;
• The third parties may only use the data for the purposes as determined by Procotex in accordance with this Privacy Statement.

Notwithstanding the foregoing, Procotex may need to disclose your personal data:

• To the competent authorities (i) when Procotex is required to do so by law or in connection with proceedings and (ii) in order to safeguard and defend the rights of Procotex;
• If Procotex transfers all or part of its assets to a third party, in the event of a transfer of a universality or branch of business, merger, demerger or similar transaction, joint venture, reorganisation or any other transfer or transition or corporate restructuring, whether by special or general title, in which case your personal data may be transferred to a third party.

If Procotex transfers your personal data outside the European Economic Area (EEA), then Procotex will ensure that this is done (i) by means of a transfer agreement containing standard contractual clauses, as provided for in the “Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council”, (ii) in application of an adequacy decision issued by the European Commission or (iii) on the basis of another permissible mechanism of transfer under the applicable regulations governing the processing of personal data.

Procotex considers it important that your data is handled in a secure manner and uses various security technologies and measures to appropriately protect your data from unauthorised access, misuse, loss or unwanted disclosure.

What rights do you have as a data subject?

As a data subject, you have a number of rights that you can exercise against Procotex. If you wish to exercise any of these rights, please contact Procotex using the contact details provided above.

The rights you have are as follows:

• right of inspection : you have the right to acquaint yourself with the data held by Procotex in order to ascertain the purposes for which Procotex uses them;
• right of adaptation or rectification of data: you can request that incorrect or incomplete data be corrected or completed respectively;
• right to object if you disagree with the way Procotex processes your personal data;
• right to data portability: under certain conditions, you have the right to obtain your personal data in a structured, common and machine-readable form and to transfer it to third parties;
• right to data erasure : under certain conditions, you have the right to have your personal data erased, this request may be refused;
• right to restriction of processing.

In principle, you can exercise these rights free of charge. To do so, you must send Procotex a request, preferably accompanied by a copy of your identity card or another document that allows Procotex to identify you, in order to prevent any unauthorised disclosure of your personal data.

If your request is manifestly unfounded or excessive, Procotex may charge a reasonable fee to cover the administrative costs associated with your request.

In any event, Procotex will always inform you of the action taken on your request at the latest within a period of one month.

Children

Procotex requests children under the age of 13 not to disclose personal data to Procotex, unless consent is obtained from parent(s) or guardian(s). If Procotex discovers that personal data of a child under 13 is being processed without that consent, Procotex will delete that data as soon as possible.
